    The purpose of punishment is rooted in the social understanding that a person who has committed an unacceptable act must be punished. Imprisonment restrains physical freedom and deprives a person of liberty, which is a harsh consequence for anyone living in a free, democratic society.

    In criminal proceedings, it may appear on the surface that reaching a conviction takes an excessively long time, and it may even seem that defense attorneys are working to protect the perpetrator. However, under the Constitution and criminal procedure law, efforts to protect a defendant also serve the purpose of minimizing harm caused by government and prosecutorial overreach.
