Changing status from F-2 while remaining in the U.S.
I had been staying in the U.S. on F-2 status through my mother.
The problem is that my mother’s change of status was denied and she has to leave the U.S. How can I safely apply to change from F-2 to another status in this situation?
An F-2 holder must file for a change of status before the associated F-1 holder departs the country. F-2 holders attending school are generally not permitted to attend full-time, but there are cases where they do attend full-time. In that situation, USCIS may raise this as an issue but will typically give a certain period of time as an opportunity to address it.
It’s best for F-2 holders to file their change of status before the associated F-1 holder leaves for Korea, so there are no complications. If USCIS gives you a certain amount of time to petition or explain your situation, we recommend providing that explanation before departing.
