My relationship with my employer has soured while waiting after filing I-485. I’d like to know if there’s a way to handle this.
Hello. While going through employment-based immigration with a sponsor, my relationship with the owner became strained, leading to a conflict.
The conflict was over labor exploitation and unpaid wages.
I tried to discuss this, which led to further conflict, and now the angry employer says they’ll cancel the employment-based green card they filed on my behalf.
I’d like to know if the employer can unilaterally cancel the green card this way, and whether I would become out of status.
If I-485 has already been filed and you’re currently employed there, the employer cannot maliciously cancel the employment-based green card they sponsored. If they try to cancel it, or if you need to leave the job, you can find a new employer and change jobs while continuing the same green card process. Please refer to the AC21 law.
