Question about filing H-1B as an August graduate
I’m applying for H-1B, but since I haven’t graduated yet, I’m unable to file. I’d like to know if I can still file early and have it approved without being denied.
I’d like to know what options are available.
The safest approach is to file the H-1B petition after actually obtaining your degree, but if that’s difficult due to an August graduation, you could first obtain a letter of expected graduation from your school and submit that with the petition.
Depending on the examining officer, some may reject the petition for not meeting the degree requirement, while others may hold the decision pending until you can prove you’ve obtained your degree (i.e., until August).
