Should I start on student status, switch to E-2, and change status within the U.S.?
I’m planning to change directly from student status to E-2 status. I haven’t yet decided whether it would be better to change status within the U.S., or go back to Korea and receive the visa there.
I’d appreciate advice on the best approach.
If possible, we recommend first changing status to E-2 within the U.S., and once the business’s income grows, going back to Korea to obtain the actual visa stamp. Also, when applying for the E-2 visa, you’ll need to sufficiently demonstrate that you are not personally directly involved in day-to-day operations of the business. For example, prepare documentation showing that employees are the ones handling the business operations.
