Whether re-entry is possible if I return to Korea after an E-2 extension denial
I entered on an E-2 visa from Korea and ran a business, but was rejected at the second renewal. My attorney appealed, but USCIS said it wasn’t eligible for appeal.
So my attorney appealed again but hasn’t heard back, and told us to go back to Korea and get a new visa. Since I was already running the business and got an uncertain answer, I filed a sibling sponsorship and continued staying in the U.S.
1. Can I obtain a green card through the sibling sponsorship?
2. Is there a way to pay a fine and continue?
3. Would my personal assets be confiscated if I’m deported for being out of status?
First, if you leave the country, there’s a high chance it will be difficult to receive a visa and re-enter.
Also, there’s no fine, and the sibling sponsorship is possible.
There’s no asset confiscation upon removal.
