Whether there would be a problem proceeding with I-130 given a prior deportation order
I’ve previously received a deportation order. In this situation, I’d like to know what problems I might expect if I proceed with I-130 through marriage.

If there’s a deportation order (including voluntary departure), there are cases where ICE waits to arrest someone at the I-130 interview. This practice was already ruled unlawful in Maryland, yet other states unaware of that ruling still sometimes wait to make an arrest.
